Federal High Court Orders Immediate Release of Abia Lawyer, Emperor Ogbonna, Awards N1.5 Million Damages Against the DSS For His Illegal Detention

The Federal High Court, sitting in Umuahia, Abia State, has struck out the charge filed against an Aba-based activist-lawyer, Emperor Ogbonna, fat instance of the 
Abia State Government, for lack of diligent prosecution. The Court awarded a cost of N1.5 million against the Department of States Services (DSS) for illegally detaining Mr Ogbonna.

While ordering immediate release of Mr Ogbonna from the custody of DSS, and restraining the DSS and its sister agencies from further arresting, detaining or harassing the activist, the Court also reprimanded the DSS for importing the proscribed IPOB into the whole issue in order to give the case the flavour of a terrorist charge. The court added:

Using uncouth language and insult against the president or DSS is unprofessional, but does not by any means constitute inciting activities against the state,."

It would be recalled that Emperor Gabriel Ogbonna Esq was arrested, at the instance of Dr. Anthony Agbazuere, the Chief of Staff to the Governor of Abia State, following a Facebook post by Mr Ogbonna wherein Mr Ogbonna claimed that Governor Okezie Ikpeazu of Abia State had visited a shrine outside the country, where he made a secret oath of allegiance to the former Governor of the State, Senator T.A Orji.
